6/17/09-A new law bans the practice of operating a motor vehicle while reading, typing or sending text messages. It takes effect Dec. 1.
Previously HB1094, the new law also makes it illegal for drivers under 18 to talk on handheld cell phones while driving. Hand-free devices are allowed. Exceptions also will be made for emergency calls.
Violators would face $50 fines.
3/2/09-A bill has died that sought to prohibit the use of hand-held phones while driving. Hands-free devices still would be permitted.
Sponsored by Rep. Claire Levy, D-Boulder, HB1094 remained in committee at the deadline to advance from the House, effectively killing it for the year.
The bill called for prohibiting drivers under 18 and cab drivers from talking on any phone. In addition, drivers of school buses, taxis and any publicly regulated vehicle would have been banned from talking or texting on cell phones.
Violations would have been a primary offense. Fines would have been $100.
Exceptions would have been made for emergencies.
